On June 4, local time, Jess Asato, a Labour MP from the UK's ruling party, officially announced a lawsuit against xAI, the artificial intelligence company owned by Elon Musk. She accuses its chatbot Grok of being used to generate fake bikini images of her, alleging privacy violations. This is the first lawsuit targeting AI system design defects, aiming to establish a legal precedent that holds companies accountable for potential misuse of their AI products.

According to the complaint Asato filed with the High Court in London, after she publicly criticized the spread of deepfake pornographic content online in January, someone used Grok to create fake images of her in a bikini without her consent. She is charging xAI with improper use of private information under the Data Protection Act and is seeking damages. "No one can strip me down on the street and put me in a bikini. I don't understand why someone can do that online. It doesn't feel exactly the same, but it's very similar," Asato said in a statement.

The key point of this lawsuit is that Asato is not going after the direct abuser but is instead targeting xAI's responsibility for the design of the Grok system. She hopes to establish through this case a principle that AI companies cannot evade legal liability for the infringement caused by their technology by claiming "the tool is innocent." xAI has not yet responded publicly. If the case succeeds, it could have far-reaching implications for global AI regulation, especially regarding accountability for deepfake content.
